What the Electronic Transactions Law asks for, and how to keep a record that holds up.

6 min read

The short answer

Yes. Saudi Arabia's Electronic Transactions Law recognises electronic signatures and electronic records. What matters is being able to show who signed, that they meant to sign, and that the document has not changed since.

What makes a signature hold up

Three things: identity (who signed), intent and consent (they chose to sign this document), and integrity (the document and its record have not been altered). A good audit trail captures all three.

Before you send

Confirm the right signers and their order, decide whether identity verification is needed, and make sure every party is reading the same final version.

What to keep after signing

Keep the signed PDF together with its completion certificate. The certificate lists each event, who performed it and when, so you can show the record without rebuilding it from emails.

When to ask a lawyer

Some document types and transactions have their own requirements. For those, check with your legal advisor before relying on an electronic signature alone.
